About the Johns Manville Trust

Johns-Manville Corporation was, for most of the 20th century, the largest asbestos manufacturer in the world. Founded in 1858 and dominant in pipe insulation, asbestos cement, roofing materials, and refractory products, the company manufactured asbestos-containing products at industrial scale from roughly 1900 through the early 1980s. Internal documents later revealed in litigation showed Johns-Manville executives knew of the lung-disease risks of asbestos as early as the 1930s but suppressed the information for decades.

By 1982, facing more than 16,500 personal injury lawsuits, Johns-Manville filed for Chapter 11 bankruptcy — the first major asbestos manufacturer to do so. The reorganization plan establishing the Manville Personal Injury Settlement Trust, confirmed by the bankruptcy court in 1986 and operational since 1988, became the template for every asbestos trust that followed.

Bankruptcy and trust establishment

The Manville Trust was the first § 524(g) channeling-injunction trust ever created and remains the largest by total claims paid (over 800,000 individual claims processed since inception). The trust was funded with a combination of Manville stock, insurance proceeds, and ongoing operating-company contributions; today it continues to pay claims at a 5.1% pro rata percentage. Despite this relatively low pro rata, Manville claims remain a foundational part of nearly every asbestos compensation strategy because of the breadth of products covered — virtually any worker exposed to asbestos in the construction, shipbuilding, or industrial sectors during the 20th century has a documented Manville exposure path.

Products and exposure sources covered

Manville manufactured what was probably the most diverse asbestos product line in the United States. The company's pipe insulation (sold under multiple brand names including Thermobestos and Banroc) was used in virtually every Navy ship built between 1940 and 1980, in industrial power plants, and in commercial buildings nationwide. Manville block insulation lined boilers, ovens, and high-temperature equipment across heavy industry. The company was also a major producer of asbestos cement (used in pipes, panels, and roofing), fireproofing sprays, and textile products.

Specific asbestos-containing products manufactured or distributed by this company:

  • Pipe insulation
  • Block insulation
  • Roofing
  • Asbestos cement

Eligibility criteria

To file a claim with the Johns Manville Trust, you generally need to demonstrate:

  • Qualifying diagnosis: Mesothelioma, Lung cancer, Asbestosis, Other cancer
  • Documented exposure to Johns Manville Trust products during the trust's covered exposure window (1900–1985)
  • Work history records placing you at a job site where these products were used (employer records, union records, witness statements, military service records)
  • Medical documentation (pathology reports, imaging, treating physician records)

Because Manville products were so widely distributed, the trust accepts claims from a uniquely broad range of occupations. Insulators are the most heavily represented group historically, but Manville claims are routinely filed by Navy veterans, shipyard workers, boilermakers, pipefitters, electricians, welders, machinists, construction workers, and industrial maintenance personnel. The trust's exposure window (1900–1985) is the broadest of any major asbestos trust.

How to file with the Johns Manville Trust

  1. Gather documentation — diagnosis records, work history, military service records (DD-214), product identification
  2. Complete the trust's claim form — Each trust has its own form
  3. File with all applicable trusts — multi-trust filing simultaneously is the standard approach
  4. Trust review — typically 3–9 months
  5. Payment — typically 2–6 months after approval

Most claimants qualify for several trusts, not just one. Filing with all applicable trusts at once maximizes total compensation. Start your free case review and we'll identify every applicable trust for your specific work history.

Compensation amounts

Reported scheduled value for mesothelioma claims: $30,000. The trust's current pro rata payment percentage is 5.1%, meaning the actual payout typically falls in the range of $1,100–$4,500.

These figures are based on Trust Distribution Procedures (TDPs) and historical payout data. Pro rata percentages can change. Actual recovery varies by case factors including diagnosis severity, exposure documentation, and trust funding levels at the time of payment. Past payouts do not guarantee future amounts.

Common qualifying occupations

The Johns Manville Trust commonly accepts claims from workers in these occupations:

Insulator Boilermaker Pipefitter Navy Shipyard Construction Electrician Welder Machinist

Multi-trust filing strategy

The Johns Manville Trust is rarely the only trust a mesothelioma claimant qualifies for. Most workers exposed to pipe insulation were also exposed to products covered by other bankruptcy trusts. Filing with multiple trusts simultaneously is standard practice and significantly increases total compensation.

Deadlines and statute of limitations

The Johns Manville Trust generally accepts claims on a rolling basis with no fixed annual deadline, though the trust may modify procedures from time to time. The applicable statute of limitations for the underlying asbestos claim depends on your state of residence and typically runs from the date of diagnosis (1–3 years in most states for personal injury; longer for wrongful death in some jurisdictions).

Always verify current deadlines with the trust administrator or a licensed attorney before filing. We track deadlines for our clients so you don't miss a filing window.

Frequently asked questions

Why is the Manville Trust's pro rata percentage so low (5.1%)?

The Manville Trust was funded based on 1980s-era estimates of total expected claims. Actual claim volume has far exceeded those estimates over four decades, leading to a low pro rata payment percentage to ensure all current and future claimants receive equitable compensation. Despite the low percentage, Manville remains a worthwhile filing because (1) the trust covers nearly every asbestos worker, and (2) Manville claim approval typically supports applications to other trusts.

Can I file a Manville claim if my employer wasn't Manville directly?

Yes. The Manville Trust accepts claims from anyone who can document exposure to Manville-manufactured products, regardless of who you worked for. If you used or were near Manville pipe insulation, block insulation, or other Manville products as part of your job, you may qualify.

Is the Manville Trust still accepting new claims?

Yes. As of 2024, the Manville Trust continues to accept claims on a rolling basis. Statute of limitations for the underlying tort claim depends on your state of residence (typically 1-3 years from diagnosis).

How long does a Manville claim take?

Manville claims typically process in 4–9 months from filing to payment, depending on documentation completeness and case complexity. Wrongful death claims may take slightly longer.

Can my surviving spouse file a Manville claim if I pass away before filing?

Yes. Wrongful death and estate claims are accepted by the Manville Trust. The applicable statute of limitations for wrongful death runs from the date of death, not the date of original diagnosis, in most states.
